Holder Mattress Drawing Official Rules

NO PURCHASE NECESSARY. PURCHASE WILL NOT IMPROVE CHANCES OF WINNING.

ELIGIBILITY: The “Holder Mattress Company Mattress” drawing (“Drawing”) sponsored by Indiana Design Center, LLC (“Sponsor”) begins Thursday, April 21, 2022 and ends Thursday, April 28, 2022 at 9 p.m. Eastern Standard Time (“Promotion Period”). The Drawing is open to legal residents of the state of Indiana ages eighteen (18) or older. Current employees of Pedcor Companies, LLC and Holder Mattress Company, and members of their households (whether related or not) are not eligible to win.  One entry per person.  This drawing is void where prohibited.

TO ENTER: During the Promotion Period, you may enter to win at the Indiana Design Center Spring Open House which takes place from 5:30 pm to 8:30 pm on Thursday, April 28, 2022. Entries may also be submitted through the mail and sent to Indiana Design Center, 200 S. Rangeline Rd, Suite 207-C, Carmel, IN 46032. No mechanically reproduced entries of any kind are permitted. Illegible and incomplete entries are void. Sponsor is not responsible for lost, late, misdirected entries or entries not received regardless of cause.

PRIZE DRAWING: Potential winner(s) will be selected via a drawing to be held on Friday, April 29, 2022. Odds of winning will depend upon the number of eligible entries received.

PRIZES: The eligible subscriber selected by random drawing (“Winner”) will receive a $2,000 gift card to Holder Mattress Company (the “Prize”) intended and promoted to be used towards a mattress purchase of equal or lesser value. The Approximate Retail Value (ARV) of the Prize is $2,000.

ADDITIONAL PRIZE CONDITIONS: By accepting the Prize, the Winner agrees to release and hold harmless the Released Parties, each of their related companies, and each of their respective officers, directors, employees, shareholders, and agents from and against any claim or cause of action arising out of participation in the Drawing or receipt or use of the Prize. The potential Winner must sign and return to the Administrator, within five (5) days of the date of notice or attempted notice is sent, an Affidavit of Eligibility, Liability & Publicity Release in order to claim his/her Prize. Note: The Affidavit sent to a potential Winner will require that the Winner provide their Social Security Number to the Administrator, which will be used solely for tax reporting purposes. The Winner is responsible for all local, state, and federal taxes associated with the receipt of the Prize. The Winner must note that the value of the Prize is taxable as income and an IRS Form 1099 will be filed in the name of the Winner for the value of the Prize. The Winner is solely responsible for all matters relating to the Prize after it is awarded. If a Prize or Prize notification is returned as unclaimed or undeliverable to a potential Winner, if a potential Winner cannot be reached or does not comply with notification instructions within three (3) days from the first notification attempt, or if a potential Winner fails to return requisite document(s) within the specified time period, or if a potential Winner is not in compliance with these Official Rules, then such person shall be disqualified and, at Sponsor’s sole discretion, an alternate Winner may be selected by a random drawing.

Prize is awarded “AS IS.” Neither Sponsor nor Sponsor Affiliates make or offer any warranty or guarantee, either express or implied (including, without limitation, quality, merchantability and fitness for a particular purpose) in connection with this Drawing or any Prize. Prize details and availability are subject to change, in which case a prize of equal value may be substituted at Sponsor’s sole discretion. Prize consists only of the item listed, is non-transferable, with no cash redemption or substitution except at Sponsor’s sole discretion. Federal, state, or local taxes on prizes, if any, and any other costs, fees or expenses not listed above are the sole responsibility of each winner.

NOTIFICATION: Winners will be notified by email to the address provided at sign-up. Winners must claim Prize by responding to the email within 48 hours of notification. Sponsor reserves the right to substitute any prize with prize of equal or greater value. If a potential winner fails to timely claim the prize, is disqualified, or if the prize notification is returned as undeliverable, Prize will be forfeited. In such, an alternate winner will be selected by random drawing. If by reason or printing or other error, more prizes are claimed than the number of Prizes set forth in these Official Rules, a random drawing will be held to award the advertised number of Prizes. Under no circumstances will more than the advertised number of Prizes be awarded.

PUBLICITY & MARKETING: Acceptance of any prize constitutes permission to the Sponsor to use winner’s name, voice, statements, image and likeness for purposes of advertising and trade, in any medium, without further compensation or notice, unless prohibited by law.

NO LIABILITY & INDEMNIFICATION: Sponsor and Sponsor Affiliates are not responsible for and entrants release each from any failures of any kind (whether caused by computer, technical, or human error) which may either limit the entrant’s ability to submit an entry, claim a prize, or otherwise participate in this Drawing, or Sponsor’s ability to include all eligible entries, conduct random drawings, notify potential winners, or otherwise execute this Drawing in the manner intended. Entrants further release and agree to indemnify Sponsor and Sponsor Affiliates from any and all liability, claims or actions of any kind whatsoever arising from injuries, damages, or losses to persons or property which may be sustained in connection with this Drawing including, but not limited to: (a) the receipt, ownership or use of any prize awarded; (b) any travel or prize-related activity; (c) any typographical or other error in these Official Rules or any other materials disseminated by Sponsor; and (d) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with any equipment, systems, networks, lines, satellites, servers, computers, or providers used by an entrant or Sponsor.

OTHER TERMS: Decisions of Sponsor on all matters related to the Drawing are final. Any disputes arising under this Drawing or any Prize will be subject to the internal laws of the State of Indiana and exclusive jurisdiction and venue shall be in the state or federal courts located in Indianapolis, Indiana. Sponsor reserves the right to cancel or modify the Drawing for any reason, including but not limited to, if fraud, misconduct or technical failures destroy the integrity of the Drawing. Sponsor reserves the right to disqualify or prohibit the participation of an individual if fraud or tampering is suspected, or if the individual fails to comply with any requirement of participation or with any provision in these Official Rules.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE OPERATION OF THIS DRAWING IS A VIOLATION OF CRIMINAL & CIVIL LAWS. SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND/OR SEEK DAMAGES FROM ANY INDIVIDUAL MAKING ANY SUCH ATTEMPTS TO THE FULL EXTENT PERMITTED BY LAW.

WINNER LIST: To obtain a list of winners, send a self-addressed, stamped envelope (residents of Vermont may omit return postage) to: Indiana Design Center, 200 S. Rangeline Rd, suite 207-C, Carmel, IN 46032. Requests must be received within six months of the applicable contest expiration date.
